3. Services Offered

IK Pilates operates two Pilates studios in the Pavlove Pole district of Kharkiv, offering group classes, duet sessions and personal training on professional studio apparatus, together with an online platform through which those services are booked and managed.

We are not a medical institution. We do not provide medical diagnosis, treatment, physiotherapy or rehabilitation services, and nothing offered by us substitutes for professional medical care.

4. Applicable Legislation and Supervision

We conduct our activity in accordance with the law of Ukraine, including the Civil Code, the Commercial Code, the Tax Code, the Law "On Protection of Consumer Rights", the Law "On Electronic Commerce", the Law "On Personal Data Protection", the Law "On Copyright and Related Rights", and the legislation on physical culture and sport, sanitary rules and civil protection.

The authorities competent for our activity include the State Service of Ukraine for Food Safety and Consumer Protection in relation to consumer matters and sanitary requirements, the Ukrainian Parliament Commissioner for Human Rights in relation to personal data, the State Tax Service of Ukraine in relation to taxation, and the State Emergency Service of Ukraine in relation to civil protection and fire safety.

5. Professional Qualifications and Insurance

All instructors engaged by IK Pilates hold recognised professional Pilates qualifications issued by established international certifying bodies, and are trained on the apparatus they supervise. Qualification records are maintained by the studio and are available for inspection by the competent authorities and, on request, by clients.

Instructors do not diagnose, treat or prescribe. Where a client's condition requires medical supervision, we will ask for clearance from a treating physician before accepting a booking.

We do not insure clients against injury sustained during participation, and no statement on this page should be read as providing you with insurance cover. We recommend that you hold personal accident and health insurance appropriate to your circumstances.

6. Safety, Civil Protection and Air Raid Alerts

Our premises, apparatus and operating procedures comply with Ukrainian safety and sanitary requirements applicable to sports facilities.

Apparatus is inspected and maintained on a documented schedule. First aid supplies are kept on the premises and staff are trained in basic first aid and emergency response. Emergency exits, evacuation routes, the location of the nearest shelter and instructions for behaviour during an air raid alert are displayed at each studio.

The rules that apply when an air raid alert is announced before or during a session, and the consequences for your booking, are set out in Section 6 of our Terms of Use.

Incidents and injuries are recorded in an incident register. A client involved in an incident may request a copy of the entry relating to them.

7. Consumer Rights

Where you contract with us as a consumer, you enjoy the protection of the Law of Ukraine "On Protection of Consumer Rights" No. 1023-XII, which remains in force at the date of this page. The new Law No. 3153-IX of 10 June 2023 will enter into force in accordance with its final provisions, and these documents will be updated when it does.

Your rights include the right to complete, accurate and timely information about the service, its properties and its price before you commit; the right to a service of proper quality performed with due care; the right to safety of the service for your life and health; the right to compensation for damage caused by a service of improper quality; and the right to judicial protection, with exemption from court fees in claims for the protection of consumer rights and the option to bring proceedings at your own place of residence.

The right of withdrawal for distance contracts, and its exclusion for leisure services provided at a specific time, are described in Section 10 of our Terms of Use.

Prices displayed on the platform are stated in Ukrainian hryvnia and are the final prices payable by consumers. We apply the simplified taxation system and no value added tax is added to the displayed price.

8. Complaints

Complaints should be addressed in the first instance to studio@ikpilates.com. We will acknowledge within 7 days and answer substantively within 30 days, stating our reasoning.

If our answer does not resolve the matter, you may apply to the State Service of Ukraine for Food Safety and Consumer Protection or its territorial body in the Kharkiv region, or bring proceedings before the competent court of Ukraine.

9. Intellectual Property

The IK Pilates name and logo, the design and content of our website and applications, our photographs and video, our class descriptions and programme materials, and the structure and code of the platform are protected by copyright and related rights under the Law of Ukraine "On Copyright and Related Rights" and belong to or are licensed to IK Pilates.

Use of our materials beyond what is permitted by mandatory statutory exceptions requires our prior written consent. Requests may be sent to legal@ikpilates.com.

We respect the intellectual property rights of others. If you believe that content published by us infringes your rights, please write to legal@ikpilates.com identifying the content, the right relied on and your contact details, and we will examine the matter promptly.

Apparatus and equipment brand names appearing on our platform are the trade marks of their respective proprietors and are used for identification purposes only.

10. Liability for Website Content and Links

We take reasonable care that the information published on our website is accurate and current, but we do not warrant that it is free of error or omission. Schedules, prices and availability may change; the information displayed in the booking system at the time of booking prevails.

Our website may contain links to third-party sites, including map, social media and payment information services. We have no control over the content of those sites and accept no responsibility for them. Following such a link takes you outside our privacy and cookie arrangements.

Our liability in connection with the use of our services is set out in Section 15 of our Terms of Use.

11. Technical Providers

Our platform is operated using the following infrastructure providers, whose role in relation to personal data is described in our Privacy Policy and Data Protection White Paper.

Hosting outside the territory affected by hostilities is a deliberate resilience measure: your booking and account records remain available even where local infrastructure is damaged.

12. Accessibility

We aim to make our services usable by as many people as possible, including those with mobility limitations or sensory impairments.

Our website is built to work with keyboard navigation, screen readers, browser zoom and both light and dark display modes. If you encounter a barrier, please write to studio@ikpilates.com and we will address it.

If you have specific accessibility requirements for a visit to the studio, please tell us in advance so that we can make appropriate arrangements.

13. Equal Treatment

IK Pilates provides its services without discrimination on grounds of race, ethnicity, nationality, religion or belief, sex, gender identity, sexual orientation, age, disability, veteran status or any other protected characteristic, in accordance with the Law of Ukraine "On the Principles of Prevention and Combating Discrimination in Ukraine".

Discriminatory conduct by any client or member of staff is a ground for exclusion from the studio.

14. Payment Transparency

We accept payment by bank transfer to the account published in the payment details on our Prices page, and at the studio. We do not accept payments from third parties unconnected with the client, and we do not accept payment in crypto-assets.

Our published bank details are the only accounts to which payments should be made. We will never notify a change of bank details by email or messenger alone; if you receive such a message, please telephone us before transferring any funds.

15. Document Set and Precedence

In the event of a conflict, the Terms of Use prevail on contractual matters and the Privacy Policy prevails on the description of personal data processing.

16. Amendments

We may amend this page to reflect changes in our details, our providers or the applicable law, including the entry into force of the new Law on Protection of Consumer Rights. The version number and effective date at the head of the page identify the applicable text, and earlier versions are retained and available on request.
